4. Force Majeure

We shall not be liable for any failure or delay in performance of our obligations under these Terms and Conditions due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, governmental actions, technical failures, or interruptions in third-party services.

5. Exclusion of Consequential Damages

Under no circumstances shall we be liable for any loss of business, lost profits, loss of anticipated savings, loss of business opportunity, loss of goodwill, loss of data, or any other indirect or consequential loss or damage of any kind arising from your use of our services.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

Jurisdiction

You irrevocably agree that the courts of New South Wales, Australia shall have exclusive jurisdiction to resolve any dispute arising out of or relating to these Terms and Conditions or your use of our services. You waive any objection to venue in these courts and any claim that such courts are an inconvenient forum.

Assignment
